contract /right issues in early 79 with Communique songs ?

I was listening to wdr-radio on 17th/02/1979



at some point, Mark is saying : "we can't play new songs, we just can play songs from the album"

about Eastbound train , he's saying that the songs isnot on the record, but that  they are "allowed" to play it (beacuse of the B side of the SOS single release ?)

but waht about Whats' The Matter Baby ? they play it, and it odesn't feature on any release (at the time)

the strange thing is that this gig doesn't feature any song from Communique album

of course the album wasn't released yet, but the day before, on Rockpalast, they played songs from communique.

and during spring 79, all gigs featured songs from Communique, even in 78 fall, before the recording sessions

so why particulary this quote on this gig ? because it was brodacasted ? but the rockpalast was broadcasted too...


I remember hearing Mark saying this kind of thing on over bootlegs (I believe on Philadelphia 3th/03/79, maybe on others)

do you know of any contract/right issues with communique album during february 79, especially in germany ?

does it depend on countries ? venues ? radio broadcast or not ?


or did I miss something ?

I think it has to do with publishing rights. straight jacket & Rondor had the rights for the first album and some songs from the second, while the rest were from Rondor solely. Maybe they were negotiations at the time about other countries or whatever.  But I am not sure.

Maybe the TV performance on Rockpalast was actually broadcast some days/weeks later and the WRD radio show was a live broadcast...

vgonis, on my remastered CD booklet, i'ts wrote : rondor/straitjacket for all songs on both albums, no distinction between songs. do you have more info ? I didn't know that songs rights were treated differently depending on albums

No, not really. Didn't have time to check the albums so I looked on MFN compilation that distinct some of them but now that I saw the albums, they really are the same publishers. Just wondering if the new songs were declared, so no one could steal them upon listening and declare them as their own.

That would explain why they played Sultans twice.  Obviously they only broadcast one version at the time of broadcast.  Since then, of course the other version has been released so we now have it on the bootleg!
