it's still copyrighted, legally there's no difference

legally you can't even upload a video made by you with a camera or a smartphone

Wow you have some strange laws in Italy.  The only one remotely unusual here in Scotland is that any Scotsman found to be wearing underwear beneath his kilt can be fined two cans of beer!  True.
